AN ACT to amend the civil practice law and rules, in relation to class actions.

 

LAW AND SECTIONS REFERRED TO: Amends the civil practice law and rules, in relation to class actions (CPLR Art. 9)

On behalf of the New York County Lawyers Association’s Committee on the Supreme Court (“the Committee”), we write to express our support for S7113/A9425.

We concur with the bill sponsor’s memorandum that New York’s class action procedures were “last revised in 1975 and should be amended to reflect improvements to the administration of class actions now available to litigants in federal courts” but not in New York’s state courts.

OCA’s Advisory Committee on Civil Practice has reviewed the proposed legislation and endorsed it in its annual Report to the Chief Administrative Judge of the Courts of the State of New York in 2019. The Advisory Committee has included the proposal in its Annual Reports for each of the years 2016-18.

The Committee believes that the proposed legislation will permit our legal community to keep pace with its counterparts and thereby further the interests of justice.

For the above reasons, the New York County Lawyers Association’s Supreme Court Committee* SUPPORTS this legislation.
