Trusts are often created to protect significant wealth from spouses upon divorce.

But … many questions also arise, including the following:

  • In what scenarios are judges more likely to interfere with a trust attorney’s most carefully laid plans?
  • How are different types of trusts treated in actions for divorce?
  • Are distributions from trusts subject to equitable distribution in a divorce?
  • When do divorce courts consider trusts merely as shams to prevent equitable distribution of marital assets?
  • Can a court order that trust distributions be used to pay support?
  • What should private client attorneys keep in mind to protect their clients’ trust interests in the event of a divorce?
