Join NYCLA’s Justice Center for a VERY SPECIAL Film Clip and Discussion concerning voting rights and recent litigation to enforce a section of the Constitution that has remained dormant for years.
Section two of the Fourteenth Amendment provides that States that suppress voting rights can lose representation in Congress – but for over 150 years it has not been enforced.
At the program, film maker Todd Drezner will present a clip from his film, Fourteen Section Two: A Case for Democracy, discussing the history of this nearly forgotten provision of the Constitution and following the journey of a lawsuit, Citizens for Constitutional Integrity v. The Census Bureau, that attempts to finally enforce it.
The case was first argued in the US District Court for the District of Columbia, where the court found that it could not reach the merits of the case because the judicial power extends to cases and controversies, and a party seeking such relief from a federal court must show that it was injured by the defendant. Plaintiff, however, failed to show it was injured by the Census Bureau’s alleged failure to follow Section 2 of the 14th Amendment, and thus the case was dismissed for lack of standing.
The case was appealed to the U.S. Court of Appeals for the District of Columbia and oral arguments were heard in April.
After presenting the clip from the film, our distinguished panel will discuss the merits of the case, the importance of the issues, as well as its likely outcome.
Along with the director of the film, panel members also include Jared Pettinato, who argued the case, and members of NYCLA’s Justice Center.
