Understand the ramifications and ethical considerations when real property and commercial leases are sold in Bankruptcy proceedings.
Hear about the duty of the trustee to assume or reject any executory contract or unexpired leases of the debtor, subject to the court’s approval, as well as whether the trustee can use, sell or lease property of the debtor under section 363 of the Bankruptcy Code.
Learn about the consequences of a section 363 sale, as opposed to a reorganization and restructuring under Chapter 11, which has become a popular method for buyers and sellers to transfer financially distressed assets relatively quickly, as well as the limitations and the process.
